  • The protection of your information and the privacy of our users is of utmost importance to Helios P2P. By providing your information to us for the provision of our services, you are agreeing to our privacy policy (as set out below) (“Privacy Policy”) and the other terms and conditions as provided in this Site. Therefore, we kindly urge users to read our Privacy Policy before using this Site and/our services. This Privacy Policy will only govern the use of this Site; it will not cover the use of a third-party website that may be accessed through this Site such as through a link or an advertisement (and Helios P2P will bear no responsibility in respect of the same).

  • WHY DO WE REQUIRE INFORMATION FROM YOU?

    The information we collect from you is the information that we consider necessary for the provision of our services (including the registration of users and facilitating the execution of loan agreements).

    The information that we collect from you is also a fulfillment of the legal obligations imposed by statutory legislation in Sri Lanka such as the Financial Transactions Reporting Act No. 6 of 2006. The collection of such information is considered mandatory as it used to also protect other users from potential fraud. We will require information such as your contact details, account details, employment details, bank statements and any other information that we may consider necessary or relevant. You will be informed of the initial documents/information required from you at the time of registration, and will be notified of additional documentation/information requirements from time to time through your registered account and/or by e-mail. Providing us with such information within the required timeframes will be a condition to continued use and access to your account and/or the Site.

  • HOW DO WE COLLECT YOUR INFORMATION?

    You are required to provide your information when creating an account in order to make use of our services. The information that is requested from you may vary depending on whether you seek to register as a Lender or a Borrower.

    Any communication by you with us such as any inquiries regarding the use of the services of this Site or any complaints will be collected and retained by the Site.

    We also use analytic and reporting technologies such as internet domain, host name, cookies, dates and times at which this Site is accessed etc. in order to obtain information about our users and enhance user experience.

  • WHAT DO WE USE YOUR INFORMATION FOR?

    The information we collect from you is used for the purposes of providing our services. We use such information to access your suitability for registration as a Borrower or Lender and to ensure that other users, our partners and ourselves are protected from potential fraud, illegal or immoral activities.

    Your information may also be used for the purpose of conducting research and obtaining statistics about our users in order to access the customer base and the success of this Site, improve our business and the services that we provide etc.

  • CHANGES TO OUR PRIVACY POLICY

    We reserve the right to make changes to this Privacy Policy as and when we wish to do so. Any changes to this privacy policy shall not be communicated to you unless you are a registered user of this Site. Any changes to this Privacy Policy shall be effective as and when they are made available on this Site. The continued use of this Site implies that you are in agreement with such changes.

  • DISCLOSURE OF PERSONAL INFORMATION

    We shall take all reasonable measures to ensure that your information is protected at all times. However, we reserve the right to disclose your information when it is considered necessary to do so, for the purposes of operating this Site and for providing our services.

    In the event we decide to undergo a merger, acquisition, or any other operation that may change the ownership or management of Helios P2P (and/or its assets), we may be required to disclose your information to the other party interested in our business such as the entity (or entities) that wishes to merge or otherwise acquire us (and/or their agents, bankers, consultants, and professional advisors). In the event that Helios P2P undergoes such a transition, the personal information of all the users may be transferred. In the event such a transition is to take place, we shall notify all our registered users, and ensure that such other parties to whom information is transferred are bound by confidentiality obligations equivalent to those contained in this Privacy Policy.

    We may disclose your personal information to Lenders and for purposes including but not limited to responding to legal requirements, to ensure the security of our users, prevention of potential fraud, or other illegal transactions (including but not limited to money laundering).
    We may engage with various third parties for the purposes of maintaining and improving our Site. This may include but is not limited to engaging with third parties to outsource certain functions of our business. In the event that we engage with such third parties, we may be required to disclose the information of our registered users, or such third parties may have access to the information of our registered users. We shall take all reasonable measures within our capacity to prevent the unauthorized disclosure of information, but shall not be responsible where such unauthorized disclosure occurs and causes any loss or damage or the actions or omissions of third parties.

    In general, although we take all reasonable measures within our capacity to protect the information of our registered users, it should be noted that not all transactions that take place on the internet are safe. Helios P2P shall not be responsible for any actions of any third parties, or events that are outside our control that may lead to a loss of information, breach of security and any unauthorized access. Therefore, we urge our users to take necessary precautions when providing confidential information and dealing with transactions online.

  • THE USE OF COOKIES

    Cookies are small files that are stored on the user’s computer. We use cookies for the purposes of improving your Site experience. The use of cookies assists us in identifying users and allows the customization of web pages among other things.

  • THE USE OF EXTERNAL SITES

    The use of this Site may give users access to external sites such as social media webpages of Helios P2P. Such pages are not governed by this Privacy Policy or in general, the Terms and Conditions. We cannot confirm the security of such sites and shall not be responsible for the actions or omissions of such third parties. Helios P2P shall not be responsible for the loss or misuse of information that may occur in the event third parties have access to the information of the users through the use of such external sites.

  • PRIVACY OF THE USER’S ACCOUNT

    Our registered users shall have access to their accounts and their information. Each registered user is given a username and password. Registered users are responsible for ensuring the safety of the username and password for the account and ensuring that access is not provided to unauthorized third parties. However, it should be noted that the internet is not always secure despite the many security measures that are taken to protect the transactions that occur. Therefore, the information provided through the internet may be prone to theft and unauthorized access. By registering with this Site, users acknowledge that there is a risk that their information may be prone to such unauthorized access and theft.

    The personal information of the registered users can be accessed by our staff. We shall take reasonable measures to ensure that background searches and other reasonable inquires are conducted as per applicable laws and regulations, before hiring a staff member.

  • CHANGES TO PERSONAL INFORMATION

    Each registered user has a duty to inform us of any changes to the personal information that occur after the initial registration of the account. We shall not be responsible for any loss or damage (howsoever defined) that may result from a user’s failure to provide us with updated information such as changes in telephone numbers, email addresses, changes in bank accounts etc. If you wish to make any changes to your personal information, [please contact us by sending us an e-mail with the necessary information to info@heliosp2p.com within [three (3) working days] of having made the change].

  • DEACTIVATION OF ACCOUNT

    Registered users have the right to deactivate their accounts. In order to deactivate an account, please send an email to info@heliosp2p.com requesting deactivation of the account. Once an account is deactivated we will no longer provide the relevant user’s details on the Site. However, we shall retain their information for a minimum period of 6 years after the completion of the last transaction in order to comply with statutory obligations. We may retain your information and other documents pertaining to your account and transactions for a longer period if there is a cause for suspicion or any issue arises in relation to your transactions such as investigations or legal claims. We may also keep a record of such information, for a longer period, in accordance with our internal data retention/record keeping policies.

    Registered users shall however not be permitted to deactivate their accounts once they have entered into a loan agreement with another user. Deactivation of the relevant accounts will not be permitted for the duration of the loan agreement. .

  • PREVENT RECEIVING GENERAL COMMUNICATION FROM HELIOS P2P

    Helios P2P shall periodically issue information about any new features available on this Site, marketing offers and any changes that occur to this Site via e-mail, account notifications, calls or text messages. Registered users can choose to avoid receiving such communications from us by sending a mail requesting the cancellation of such communication to info@heliosp2p.com , or by clicking ‘unsubscribe’ (and following the instructions) on any such communications.

  • RETENTION OF YOUR INFORMATION

    Helios P2P shall retain the information you provide us for a minimum period of six years after the completion of the transaction in order to comply with statutory obligations and to prevent the occurrence of any fraud or other illegal activity. We may retain your information and other documents pertaining to your account and transactions for a longer period if there is a cause for suspicion or any issue arises in relation to your transactions such as investigations or legal claims. We may also keep a record of such information, for a longer period, in accordance with our internal data retention/record keeping policies.
